By accessing and using the services, website, or facilities of PEPT – Performance Enhancement and Physical Therapies (“PEPT,” “we,” “us,” or “our”), you (“Client,” “you,” or “Participant”) agree to the following Terms and Conditions and Liability Waiver. Please read carefully before engaging in any services.
1. Acceptance of Terms
By booking or attending any PEPT services, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use our services.
2. Nature of Services
PEPT provides exercise physiology, strength and conditioning, rehabilitation, and allied health services. Services may include assessment, exercise prescription, workshops, and consultations.
All advice and programs provided are individualized based on your assessment, health history, and goals.
3. Health and Medical Disclaimer
You confirm that you have disclosed all relevant medical information prior to participation, including injuries, illnesses, medications, or conditions that may affect your ability to exercise safely.
PEPT recommends consulting your GP or relevant healthcare professional before starting any new exercise program.
You understand that participation in exercise carries inherent risks, including but not limited to strains, sprains, or other injuries.
4. Assumption of Risk
By participating in PEPT services, you acknowledge and accept that:
You are voluntarily engaging in activities that carry a risk of injury.
You will follow instructions provided by PEPT staff and inform them immediately of any pain, discomfort, or concerns.
PEPT cannot guarantee specific outcomes from your participation.
5. Liability Waiver
You agree that PEPT, its staff, contractors, and affiliates shall not be liable for any injury, loss, or damage sustained during or as a result of participation in services, except where caused by gross negligence or willful misconduct.
You also agree to release and indemnify PEPT from any claims, demands, or actions arising from your participation, including injury, illness, or property damage.
6. Appointments, Cancellations, and Refunds
All appointments must be booked in advance.
Cancellations require at least 24 hours’ notice; otherwise, a cancellation fee may apply.
Refunds are only available where stated under specific programs or offers.
7. Personal Information and Privacy
PEPT will collect and use your personal information for the purposes of delivering services, managing appointments, and communications. We respect your privacy and comply with the Privacy Act 1988 (Cth). For details, see our full Privacy Policy.
8. Intellectual Property
All materials provided by PEPT, including exercise programs, handouts, and digital content, are the intellectual property of PEPT and are for personal use only. You may not copy, reproduce, or distribute materials without written consent.
9. Marketing and Communications
By providing your email or contact details, you may receive marketing communications from PEPT. You may opt-out at any time via the unsubscribe link in emails or by contacting us directly.
10. Governing Law
These Terms and Conditions and Liability Waiver are governed by the laws of Queensland, Australia. Any disputes arising will be subject to the exclusive jurisdiction of the courts of that state.
11. Acknowledgment and Agreement
By using PEPT services, attending sessions, or booking online:
You confirm that you have read and understood this agreement.
You voluntarily accept all terms and the liability waiver.
You acknowledge that participation is at your own risk.

Performance Enhancement and Physical Therapies is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, from other publicly available sources, and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
In order to protect your Personal Information we may require identification from you before releasing the requested information.

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.
